Environmental Liability Products

Premises Pollution Liability Insurance (PPL) provides coverage for worldwide environmental liabilities including foreign operations and subsidiaries.

• The products include:
  • a range of flexible protection for first and third-party environmental liabilities arising from both sudden and accidental and gradual pollution
  • cover for clean-up costs imposed by the Regulatory Authorities in domestic and overseas territories – includes onsite and offsite impacts
  • full third-party legal liability, including nuisance
  • first-party business interruption
  • pollution arising from the transportation of the insured’s products or waste
• Programs can be designed to cover the historic contamination of property assets and the legacy risk presented when those assets are acquired through investment or M&A or divested
• Operational environmental risks created by the ongoing business are also insured, including biodiversity or natural resource damage
• Limits are provided up to $30/€25/£20 million per claim with larger aggregates considered
• Limits are provided up to AUD$40/USD$30 million per claim with larger aggregates considered

Contractors Pollution Liability (CPL) provides coverage for environmental liability arising out of the insured's covered operations:

• Covered Operations can include a vast range of activities from facilities management to heavy civil construction
• Both annual and single project policies are available
• Cover can be on a claims made or occurrence basis
• Project policies can be written for significant contract periods
• Transportation (Auto/watercraft) can be included
• Limits are provided up to AUD$40/USD$30 million per claim with larger aggregates considered

ACE Environmental Protect ('Protect') combines the coverages available under our PPL and CPL forms:

• Coverage is on the basis of Insured Business, i.e. premises owned, leased or controlled by the insured or activities they undertake at a third-party location
• For EU locations, full coverage is provided for liability under the EU Environmental Liability Directive. This is not limited to pollution events and includes loss mitigation costs
• First-party transportation liability risks can be insured
• Pollution arising out of the insured's products can also be considered in some cases
• The Protect solution is aimed primarily at ongoing operational environmental risks, but can also address the legacy liabilities from historical contaminated land exposures
• Limits are provided up to $30/€25/£20 million per claim with larger aggregates considered
• Minimum self-insured retention is $10,000
